AN ACT TO AMEND THE CRIMINAL PROCEDURE ACT 1967. | ||

BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS: | ||
Amendment of Criminal Procedure Act 1967. |
1 .— Section 22 of the Criminal Procedure Act 1967 is amended by— | |
[GA] | (a) the substitution of the following subsection for subsection (3) (inserted by section 18 (b) of the Criminal Justice Act 2007 ): | |
[GA] | “(3) A recognisance to which subsection (2) applies may be taken by— | |
[GA] | (a) any judge of the District Court, | |
[GA] | (b) any District Court clerk, | |
[GA] | (c) a peace commissioner designated for that purpose by order of the Minister for Justice, Equality and Law Reform, | |
[GA] | (d) the governor of a prison, or | |
[GA] | (e) a prison officer designated for that purpose by the governor of a prison.”, | |
[GA] | and | |
[GA] | (b) the insertion of the following subsection: | |
[GA] | “(5) In this section ‘ prison ’ has the same meaning as it has in the Prisons Act 2007 .”. | |
Short title. |
2 .— This Act may be cited as the Criminal Procedure (Amendment) Act 2007. |
